S Joye & Associates LLC Liability Waiver Form for any, and all trips, by S Joye & Associates LLC: 

GENERAL INFORMATION, RESPONSIBILITIES & CONDITIONS PLEASE READ THE FOLLOWING CAREFULLY. DO NOT MAKE ANY PAYMENTS UNTIL YOU HAVE READ THE FOLLOWING RESPONSIBILITIES AND CONDITIONS. RECEIPT OF ANY PAYMENT INDICATES YOUR ACKNOWLEDGEMENT AND ACCEPTANCE OF THE TERMS STATED BELOW.

By agreeing to this release I fully understand and agree that my my initial deposit, up the amount of $150 is non-refundable.  I fully understand that the airfare portion of my trip is nonrefundable once it has been booked by S Joye & Associates LLC. I also agree and fully comply that if I will follow the cancellation policies. 

WAIVER ACKNOWLEDGEMENT:
To the best of my knowledge, I am in good physical condition and fully able to participate in the above-referenced trips. 
I am fully aware of possible risks and hazards connected with the participation on this trip, including physical injury or even death, and hereby elect to voluntarily participate in said events, knowing that the associated physical activity may be hazardous to me and my property. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OR LOSS, PROPERTY DAMAGE, OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me, or loss or damage to property owned by me, as a result of participation in this  "getaway” event.
I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE, S Joye & Associates LLC or project, their officers, servants, agents, and employees (hereinafter referred to as RELEASES) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in physical activity, or while on or upon the premises where any of the above-referenced events are being conducted. 
It is my expressed intent that this is a release and hold harmless agreement which shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a RELEASE, WAIVE, DISCHARGE, and CONVENTION TO SUE S Joye & Associates LLC and above named RELEASES. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be constructed in accordance with the laws of the State of Maryland.
RESPONSIBILITY & RELEASE:
This document gives notice that S Joye & Associates LLC  does not own or operate any motor coaches, aircraft, cruise lines, catering facilities, hotels or attractions and that all arrangements have been made with motor coach companies, hotels, and other independent suppliers to provide you with the services purchased in the trip upon the express condition that we shall not be liable for any injury, accident, loss, damage, delay, bankruptcy, or any irregularity which may occur either by reason of defect in any vehicle or through the acts of default of any person or company engaged in providing transportation or other services. S Joye & Associates LLC does not accept any liability for the actions or omissions of these Independent suppliers over whom The Eford Group International LLC has no direct control. In the absence of negligence on S Joye & Associates' part, therefore EACH PARTICIPANT HEREBY RELEASES S Joye & Associates LLC  for losses or damages arising from physical or emotional injury, property damages, or other economic damage caused by such factors beyond S Joye & Associates' control. Because of unforeseen circumstances, S Joye & Associates LLC  reserves the right to withdraw any trip or make any change, with or without notice, In the event of inclement weather, mechanical difficulties, or other events beyond the control of S Joye & Associates LLC  that cause delays, It SHALL NOT BE the responsibility of S Joye & Associates LLC  to pay for resulting costs and expenses to the group or trip client, including additional lodging and meals. Furthermore, It SHALL NOT BE the responsibility of S Joye & Associates LLC to reimburse the group or trip client for trip inclusions missed resulting from such delay.
OPTIONAL ACTIVITIES:
Optional activities are offered as advertised unless weather or other conditions make it Impossible for individuals to participate.
S Joye & Associates LLC  assumes no risk, liability, or responsibility for incidents or accidents which may occur to an individual while participating in any activity. Many activities are subject to a minimum participation as dictated by the operator and available transportation. Prices for all optional activities are subject to change with or without notice. THIS TRIP IS GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF MARYLAND. In the unlikely event a dispute cannot be amicably resolved and a court action is necessary, it is agreed that all disputes and demands shall be heard in the State of Maryland. 
PAYMENT CONFIRMATIONS:  
Will be sent on your monthly summary statements. We cannot individually contact each passenger for each mailed payment received. However, should you require payment confirmation, please send your payments via Certified Mail, Return Receipt or another route which would require a signature.   All checks returned for insufficient funds will be charged $35 to your account. 
CANCELLATION & REFUND POLICY:
We are at the mercy of the hotel and airline and we follow their refund/cancellation policies. 
Cancellation Made Within
30 Days or less Prior to Departure Date – No Refunds
31 Days – 50 Days to Departure – 50% of total purchase can be refunded minus any airline cancellation fee and deposit
51 – 70 Days to Departure – 75% of total purchase can be refunded minus any airline cancellation fee and deposit.
71 days or more to Departure – 100% of total purchase minus $100 cancellation fee and deposit.
The deposit of $150 is non-refundable. 
Depending upon the circumstance (e.g. death in family, illness, and at our sole discretion, we may give you a credit towards a future S Joye & Associates LLC getaway.  We strongly recommend you independently purchase travel insurance. 
We reserve the right to cancel any trip, at any time, for any reason. As such you will receive a 100% full refund of payments made to date within 7-10 business days. ​
Cancellations must be confirmed with the S Joye & Associates LLC in writing using our Cancellation Request Form.  Where any person fails to inform S Joye & Associates LLC , the person will nevertheless be billed as per the terms stated above.
S Joye & Associates LLC has to confirm receipt of cancellation for it to become valid. 

Any person and bank or financial institution returning non-refundable money back to our consumer will be sued for violation of the agreement set forth between our client and company. Remaining occupants in the room may be obligated to pay for the difference in the per person room rate for a solo traveler or will agree to another roommate if available.

All monies from a canceled guest are non-transferable to another guest, no matter their relation. Written notification must be sent by the person whom paid to request a refund of their unused monies. Refund(s) will be sent to the original payee and are made on the specific condition that the acceptance of the refund releases S Joye & Associates LLC  from all present or future claims by the participant. Reservations cannot be confirmed unless secured by the timely arrival of required deposits and final payments and rooming lists due to S Joye & Associates LLC  no later than 45 days prior. Reservations not paid in full shall be placed on a “space available basis” and are subject to cancellation policy regardless of alternative tour options that may be offered.
YOU ARE ADVISED TO PURCHASE TRAVEL INSURANCE WITH AN OUTSIDE COMPANY. 
 
RESERVATIONS, DEPOSITS AND PAYMENTS:
Deposits and final balances with rooming list must be received by S Joye & Associates LLC  on or before the appropriate due dates. Reservations for time and space cannot be confirmed unless secured by the timely arrival of these required deposits, final payments and rooming lists. Arrangements shall be made for reservations paid in full, on time and upon the timely receipt of the final rooming lists to S Joye & Associates LLC .
NO REFUNDS FOR UNUSED SERVICES or AIRLINE TICKETS:
Refunds or allowances will not be made for transportation services or other portions of the trip which are unused on or after the tour departure date. In the event of an Act of God, inclement weather, or global pandemic, S Joye & Associates LLC reserves to right to reschedule the trip for another time.
OPTIONAL ACTIVITIES, ENTERTAINMENT, AND ITINERARIES:
It is intended that all optional activities, will be offered as listed on the web advertising the trip unless weather or other conditions prevail at that time that make it hazardous or impossible for individuals to participate in the activity, S Joye & Associates LLC does not act as an agent or operate any optional activity. The decision to participate in an optional activity is solely between the trip participant and the operator of the optional activity. S Joye & Associates LLC assumes no risk, liability, or responsibility for incidents or accidents which may occur to an individual while participating in the activity. Some optional activities are subject to a minimum participation requirement and may not be available at all due to inclement weather or other Acts of God. Payment for all optional activities at the event's location which have not been prepaid must be made in USD cash ONLY. S Joye & Associates LLC  reserves the right to withdraw or change any contracted entertainer. S Joye & Associates LLC will not provide reimbursement due to “no show” entertainers or change in Itineraries. The destination hotels, transportation companies, in addition to all other providers of services, reserve the right to remove a person engaged in illegal or disorderly conduct from the tour without refund.

LEGAL AGE FOR CONSUMPTION OF ALCOHOLIC BEVERAGES:
Each trip participant must be of the minimum drinking age allowed by the State (or country)  in which the destination is located to participate in the functions or tour inclusions which contain alcoholic beverages, AND EACH TRIP PARTICIPANT MUST BE PREPARED TO SHOW 2 TYPES OF LEGAL IDENTIFICATION (ONE OF WHICH MUST INCLUDE A PHOTOGRAPH) TO GAIN ADMITTANCE INTO ANY FUNCTIONS OR EVENTS WHICH SERVE ALCOHOLIC BEVERAGES. Each liquor licensee is under legal obligation to comply with all applicable laws. To that end, each liquor licensee is required by law to not serve alcoholic beverages to individuals who do not meet the standard of service even though they may have paid for the alcoholic beverage inclusion as part of their tour.

PHOTO/VIDEO RELEASE:
As a traveler, I hereby give permission for my images through video, photo and digital camera, to be used solely for the purposes of S Joye & Associates LLC 's promotional material and publications, and waive any rights of compensation or ownership thereto.
ROOM ASSIGNMENTS:
Room assignments are made by the hotel personnel. Per person prices may be stipulated by the number of people in the room, not the number of beds. 
WE RESERVE THE RIGHT TO CANCEL YOUR TRIP, AT ANY TIME, FOR ANY REASON and will refund any applicable monies, with the exception of your trip's deposit and any deductions from any of our travel partners, including hotel and airlines. 
I UNDERSTAND IT AND (ELECTRONICALLY) SIGN IT VOLUNTARILY with my paid deposit as my own free act and deed; no oral representations, statements or inducements, apart from the foregoing written agreements have been made; and I acknowledge and represent that I HAVE READ THE FORGOING Waiver of Liability and Hold Harmless S Joye & Associates LLC.
